Insurance offer for totaled Cobalt

Insurance offer for totaled Cobalt
This is now the TRILOGY, but seriously. Fellas, as you know, a lady fell asleep at the wheel and slammed into the front of my 3 week old, 1256 mile Cobalt SS/TC that was parked.
I just got off of the phone with the other lady's insurance company and they offered me
$21,987.82 for the car
+1,313.82 in tax
+55.00 for transfer of tag fee.
$23,265.82 GRAND TOTAL offer from insurance company.
While this doesn't put me upside down on the loan, do you think I could get more? I was looking for used 09 Cobalts in my area (50 mile radius using me zip of 19078). There are about 1-2 used ones, one with 8,000 miles and the dealer was looking for $20,995 (mine had 1256 miles on it).
I'm thinking my only option to fax in to the insurance company for "comps" are new Cobalt prices.
What are your thoughts? Should I strike for rebuttal against the insurance company or settle and call it a day. The headache is still here, but not as bad as before, but I'm honestly getting tired of dealing with the insurance companies, etc.

Just tell them thats not enough money.How much money did you put into your car? got reciepts? that helps.If they still want to low ball you .Do this tell them your back is starting to hurt and my neck,id probably feel better tho if i could get atleast what i owe on my car.

Just take the money, you could be getting much less than that. The advice above about showing comps or new cars is retarded. You're going to **** yourself in the ass. Take the money and call it a day.

So what exactly are you asking? Are you saying that isn't a fair deal?
I paid less than that for my 2009 with 27 miles. I think they are valuing this as a new car. I'm not even sure they took off mileage. I think they probably called dealers and asked what they could get one for cash.
I don't think they're lowballing you at all.

21500 (all options but RPD and High Wing)
1290 tax (varies by state- so doesn't count)
~150 in title/registration fees

You aren't going to get more money by threatening court- attorney's won't take property damage claims and you'd likely lose. Do you not believe that is a fair deal? And if so, why- you can't just look at the prices in the paper because those are before negotiation. If you went to your local dealer and said "I'll give you 21,987 for a Cobalt SS with these options" would they say yes? If so, then I'd say they are treating you pretty fair since technically yours was used.

Take the money, and a new tc w/ 8,000 miles for almost 21 grand is outrageous. you shouldn't have to pay that much for one with less than 50 miles on it. Get the check and grab a much better deal on a tc

Take it! They're giving you way over the value. Keep in mind it's not a new car, it's used. You drove it off the lot. Fair value would probably be, like someone already said, $19k.

Yeah, I'm just going to take it. It's easier this way than dealing with the insurance company further and going through more of a headache than I already have. I got a pretty good deal on a new cobalt so I'll just take the money that I have left over and put it into the mods that I already had on the car before.

One thing - all you guys saying it was a used Cobalt, keep in mind, he only owned it for a MONTH, and I think OP mentioned he didn't even get to make the first payment!
Although, I wish they woulda' given you that offer before 3/31, when I think you had an extra $1000 in rebates avaialble.
WHen I got mine on 3/27, I used (4) rebates:
1) Standard $1500 Rebate (or APR - I chose rebate, as my beacon is 795, I already know I can get low rates)
2) Extra $1000 cash on Cobalts
3) $1000 rebate if you have a current lease ending before 9/30/2009 (mine end 5/31/2009)
4) $500 rebate related to the South Florida Auto Show
I negotiated my car down to $23,700 (MSRP was $25,300) - ain't but (2) Cobalt SS's in the Tri-County S. Florida area, so i;m surprised I got what I got. Technically, we were at $24,347, and then ended up at $23,700 the night i drove it home. On top of that, the $4000 rebate brought it to $19,700. This is with LSD, RPD, USB Radio, Real Spare, Sunroof,High Wing.
Ended up getting a $19.8K loan, 72mos @ around 5%. Wanted a low pmt just in case times became hard.
I can always, and will start beginning with 1st pmt, sending extra $$ to bring down the principal on the back-end.
Way I though of it, is I can always pay MORE on the monthly, but I can't pay LESS without a refi, and more $$ wasted later.
Right now, I think there's only a $1500 rebate on the Cobalts, and the rest was replaced by that whole ""assurance plan" thingie, related to them making your payments if you lose your job due to the recession, providing some "upside-down protection" if you trade-in after half payments are made, etc...
With the amount they gave you, I think you SHOULD be able to replace the car with a brand-new one.
Seems most areas around the country have low prices on Cobalt SS's, just not here in S. Florida.
Question is, with what they gave you, is the payoff amount, and your out-of-pocket on the totalled car covered?
It's not SO important if you can get a replacement with zero extra out of pocket.

That makes no difference. I understand it's a "new" car to him and he hadn't made a payment, but for valuation purposes, it is used. It was purchased and driven. It no longer has new car value.

Yup^ As soon as a car becomes titled it becomes used and is valued as such. The old adage is you lose 10% for driving it off the lot.
