Severe Accident SS/TC ... UPDATED!!!!!!
IT'S TOTALED! , but at the same time
State farm gave them grief trying to combat them saying it's not totaled, but the shop was on my side. Now I have to go combat the Actual Cash value. I haven't received any calls yet from State farm, but I know they're going to low-ball me. I need some advice on figuring this situation out now, if any of you guys have anything to share, it'd be greatly appreciated!!

Anyways, I got some pictures back from the body shop yesterday. They are pretty bad . I figured I'd share some with you guys so you can see for yourselves the speed at which she must have been driving It's not just a cosmetic hit as many have thought.
Some pics may look the same, but this is with the car partially torn down.

that sucks yea it does look totaled since they are gonna gave to take apart the whole car and unbend the things back but the car will not be the same and your gonna probably have leaks. you should buy the car back and sell the car in parts youll get more out of it and have enough to pay a new one or buy parts for for the new one .

Can you say TOTALED? I wouldnt let them tell you anything else... I wouldnt want to keep it after that. Too much warping in the body and frames in my opinion, judging by all those gaps and bowing and dents. Just my opinion. Sorry man....time for a new one.

Sure its called being very strict with how you handle the situation and demand everything you wan't or you will file a lawsuit against the insurrance company .. That simple..

But, seriously a couple of questions
1. Is the car still at the shop?
2. Do you have access to take parts off the car?
3. If they low-ball instead of replace, tell them that you will take parts from the car to get back the difference!! This will turn some push some buttons.
4. Don't sign anything less than full replacement........ seriously. (Unless you had like 5000 miles)
5. Find the highest price for one right now and divide the price by an average of 150,000 miles to the miles you had on it. Tell them that you will accept only this amount.
I know this will sound corny but write a letter to the CEO. Say that service is sub par and you are not getting insurance like what you paid for. Say in it, "All I want is a new vehicle!!" It was brand new!!! Plus, make it pronounced that you are going to shop rates with other companies from the experience. This really does work. It will take time but worth it in the end if they low-ball.

I'm looking for full replacement. I've read online that I can get some quotes from dealers and in some cases (such as mine) they will usually just pay for the new car (loaded - includes taxes, transfer tags, etc. etc. that comes with buying a new car). I know that if you bark, insurance companines usually comply since the longer the car sits, the more $$$ they pay (the car right now is sitting at the body shop at a rate of
$65 per day sitting at shop rate
$25 per day - car rental
= $90 per day for every day that we don't agree on a rate.
I know that insurance companies can't say they won't pay for the car to sit because we don't agree on a rate (I've been told this by the tow company and now the body shop it's at right now).
The sad part is that there isn't even a NADA on the 09's yet, so I don't know what to at least look for from the insurance company ....
I'm kind of confused by #4 - I get the basic principle, but can you go a little further in depth ... the 150k miles is confusing (maybe because it's late at night).

Take the average (highest price you can find)
1200/150,000 and use this percentage to figure what they owe ya.
.008 x 24,3000 = 194.90
So they can only take 194.90 off the price that you would have to pay for. So pick the highest one and buy the lowest.
