Ive also been cited for "failing to yield" when I was turning left unto another road and a guy avoided re ending me and went left and side swiped me. He told the police I was making a U turn We both got cited and had to cover our cars with our own insurance. Oh and I was 18 and the guy was 40+...I kept asking for the police to give him a sobriety test but they ignored me.

Not to mention going twice the speed limit in a 15mph zone isn't exactly a bat out of hell. If it was dark and the guy had his headlights on he had to have been fairly close to the intersection if he was going 30ish.

It's never good when you have your car totaled, but the important thing is your ok. A car can always be replaced.

Sorry to hear that sam, kinda confused on the whole "reading this as your fault" statements though. "Failure to yield if he hit your front bumber" (cue hit brakes and turned left) "what your tires dont have grip?"(cue /sc balt with mods, instant boost, probably first gear still by sounds of it, bye bye traction on RAINY roads when Floored). Hope you and the lady are alright dude, again, if you need anything give me a call

these pics are from when we loaded it on the trailer post accident.

Oh and i found a state regulation that states when two people approach an uncontrolled intersection at the SAME time the the person on the left will yield. I was on the left. But i was there before him and was already in the intersection. If a car is clearly in the intersection then he has the right of way. I was over halfway through when he hit me so he couldnt have been paying attention and was assuming he had the right of way. I went to the intersection yesterday and 9/10 cars slowed down from every direction. 1/10 flew through without looking. Im taking some videos of cars at the intersection as proof.

without seeing the actual intersection it doesnt make sense to me. in MA i cant think of anywhere where there is no stop sing in any direction.

have an address, we could google earth it?

that sucks, kind of went through something similar back in 04 or so. I got a call from my g/f saying there was police and stuff at my house and thought something bad happened and could not get ahold of my parents(living at home back then) and when I tried to call home it said the service was disconnected. So I jump in my Lincoln and go to head home. Was in a parking lot, was driving down an aisle, no stop signs anywhere. I stop and look 2 times each way and as soon as I pull out I have a silverado running over the front of my car. The driver was obviously pissed but I ignored him still trying to get ahold of a someone about my house(others were calling the accident in). I ended up with a citation similar to yours that I basically tossed at the cop who really did not want to and felt bad for me but said he had too cause I failed to yield. I said, "did you not get the part where I stopped, looked both ways numerous times because of idiots and as I pull out this guy in his company truck comes flying into the parking lot!" I mean he was booking that is for sure but in the end it was whatever, my insurance covered it and I did not get penalized by them for it so no harm done really.

Accidents happen, dont get down about it or let anyone try to tell you how it should be. You and the others involved are the only ones who know the situation. They can say "how did you not see him" and blah blah, how did I not see a truck? Exactly, things happen and speed plays a huge roll, I could not see him cause he was not in sight yet and if he had obeyed laws I would of been out and on my way with no issues that day.

The officer that showed up, should have done a full report... If so, the report will include: how fast both drivers were going, exact position of both wrecked cars in the intersection etc.. Any officer can determine the speed of wrecked vehicle if the tire marks were measured right after it happened.

Still waiting on my money man. It's been since August. Last time I talked to you you said you'll have money left over from the repair.

For anyone that cares, the money I'm waiting on is from the retrofit kit I sold him (was supposed to be trade + cash), because he confused ssc springs which he said he had for stock SSSC springs.

Okay let me see if I understand this.

This incident occurred at a 4 way stop sign. An intersection if you will. (Was it four way stop or only two way?)

You made your stop, looked both ways and saw nothing coming, and proceeded to make your move across.

350z barrels through the stop sign and smashes into the SIDE of you. Your both at fault?




Now if its a two way stop, you approached the road (with stop sign>??) stopped. looked both ways and saw no traffic. proceeded to make your move across and this guy plows into the side of you? You didnt see him coming at all? The damage suggests that you started to roll out into the intersection and barely started to gradually accelerate across. If the visibility is fine then this 350z was bookin in. If you indeed slid sideways 25ft or so, he hit you at a good speed. How long were his tire marks when he slammed on the brakes? He should be at fault since he hit the side of your car. If he took the front bumper off Id say it was your fault but anybody should be able to stop for another car pulling out in front of them 60-70ft down the road. Residential area right? speed limits 35mph.

Ill put it this way when a cop looks at the damage prior to writing the citation he looks at poit of impact. If it is in the front have of the vehicle they are gonna pin it on you. If it happens to be on the back half of the vehicle more than likely they will say it is his fault. This is what a state trooper told me when i wrecked my moms suburban driving her to an ultrasound appointment when she was pregnant.

Damn the car might be totaled but you can make a lot of money off it if you decide to part it out.

Post videos/pics of the intersection so we can judge better.

One question, you said there was no stop sign or yield sign. You had no obligation to yield for anything. Did his side have any signs?

huh? Have you ever worked on your car? The sheet metal is paper thin, All that is there is a new strut, control arm, wheel, maybe some other brake parts, a fender and a door. That is very repairable.
