Yep, that's what I'm looking up. I did all that stuff for my ticket 2 years ago, I have the forms in a legal book I have. Best part is if you file the motion they have to give it to you. If they don't give it to you, they can't use it in court.

just hope that this "video" exists, otherwise if it doesn't then it's his word against yours and it will make it more difficult to prove your innocence because the "cop" is never wrong.

I would be jotting down the times of when this happened, the color car that tried racing you, what your intentions was on the road that time and above all bring a level minded head to the table. Judges don't like young men and women jumping to quick conclusions.

Just state the facts and what happened and I am sure the best thing you will get is a slap on the wrist (advisement on points) and pay a small fine. The worst thing that could happen is you get f*cked in the a$$ and take both the points and a large fine.

Remember, traffic court doesn't care about your license, they care about your money.

Either way your going to pay money so bring your checkbook. Only way out of both (fine/points) is the video I see it at this point. Trust a man who racked up 11 points in 3 months. I dealt with the law on so many levels it's not even funny.

if yall got the same ticket on the same day at the same time, odds are that yall have the same court date as well. unless he resets his. if you see him there then you should confront him about it.

I love my fart can.

Careless driving is a hard ticket to fight because there is nothing they have to prove. In the officers opinion you where driving without regard for the safety of others on the road.

It's pretty tough to win in traffic court without a lawyer. Even if you have a good excuse.

You are correct...................it's called discovery..........Your attorney has the right to it before the trial and your attorney will give it to you to view at your leisure in the privacy of your own home.

Best thing to do is jot down on paper everything that you saw or heard happen on that day..............I mean everything from what everyone said and did!!!!!!!! include the weather also and time of the alleged offence. It will help if you have any witnesses!!!! DO this immediatly so you don't forget a thing!!!!!!

Don't sweat this one..............even if convicted you still hold your license and your record will disappear after 2 years......points that is.

ALLWAYS go to court............there is a chance that the officer won't show up and you walk. If he does show........you can extend it by having a friend say that you couldn't show up because of work or that your sick and they will set a new date for you with the possibility of the cop not showing at that trial!!!! Even if you are there he will not know your face because you only saw him for ten minutes at most.

They don't have a track of how fast you were even going..........so even a doubt will be in your favour that you weren't even involved!!!!!!

I have yet to see this guy driving around, and I drive in the rt 51 area a lot. I'd like to see him though.

What color is your RedLine, I saw one the other day and was just curious if it was you.

Blue. Small spoiler...mirrored tint.

Couple other RLs running around, that I know of (blue, black, and red).

As to the "discovery" everyone's talking about -- can I do this, or do I need a lawyer to? I'm going to represent myself first time around. If I still am found guilty, I'll be appealing and getting a lawyer.

You can file it yourself, no need for a lawyer. You just have to submit the paperwork to the judge and the police department and they have to send you what they have. If they don't, you can move for the case to be dismissed because they denied you the right to discovery.

That is included in the discovery process and I would include it in your paperwork. Then if no video tape surfaces you can say "Your Honor, Officer Dipshit stated at the scene that he had video taped evidence that showed I was racing. However, when I filed a motion for discovery I was never granted said video tape." Then he's in a corner, if there is a tape and they don't give it to you, they risk the case being dismissed - if there is no tape then you've just documented to the court that the officer is a liar.

Haha...we're bouncing between forums.

Is this paperwork included in the book you're going to loan me, or something I need to pick up at the police station / magistrates?
