Law enforcement misinterprets the law all the time. Modifications and replacements are entirely different things.

Modification of an exhaust system is defined in the VC as an exhaust system being equipped with a cutout, bypass, or similar device which will amplify or increase the noise emitted by the motor of the vehicle.

A replacement is not considered a modification. The exhaust system just needs to comply with 27150 and 27151(b) and those are:

27150. (a) Every motor vehicle subject to registration shall at all times be equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise, and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device. <~ Here is the state's definition of modifications.

27151(b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer's gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, non-original exhaust equipment. <~ IN OTHER WORDS, AFTERMARKET PARTS AND SYSTEMS.

Cops say our exhaust systems are illegal, but as you can see, the vehicle code clearly states otherwise.

Oh and mufflers have absolutely nothing to do with the vehicle's emissions. It's name defines it's purpose.

w00t found my way out ^_^

im not goin to the ref to fight this ticket, imma use the mod/replace argument and take pictures to show that my **** have no cut off, that i have a muffler/resonator = win if not
then imma go get a new trial and go to the ref and pay 100+ to get a damn cert
that last for a year.

have done it twice in 2 years. it's not expensive for the inspection, but if you have a **** load of parts you cant take off yourself then it gets expensive. it's just a tedious process.

wouldnt know for sure. i do know that if it comes with a silencer it needs to be installed, most exhausts that have a silencer can be screwed in which should be ok
