Ticket/court question
#27
hey i know it sucks to get tickets, about 2 years ago i got stopped for speeding in my 06/SS i was clocked doing 100 kms in a 50km zone. the cop charged me with excessive speeding and fail to show consideration. he also tagged me for tinted windows. the fines came to $850 and i would of gotten 9 points and my insurance would of doubled with the way ICBC works out here i needed extra time to pay the fines so i filed to dispute and got a court date for about a year later as the courts were back up big time. any way my day to appear for some reason the cop was a no show, i pleaded not guilty and all charges were dismissed. i walked out of the court and considered that my lucky day, i rolled the dice and won. as for speeding its hard not to speed in a cobalt with out knowing it as they are such smooth riding cars and so quite inside with the windows up. so the best of luck to you

Generally speaking, if you're given the option of court *OR* school, it's almost always better to choose school.
Good luck!

Also 4 points will get you insurance surcharges of $150

I was eligable for trffic school after I payed my ticket. 80 in a 65. You just have to set a date to see if the judge will approve it. You gotta write a small letter stating why you should get accepted for it. Since your looking to reduce it , I doubt you will get it and get traffic school at the same time. But take a chance and try it, I might be wrong. But another option is if you can't pay the $432 right now, wait till the ticket court date is due, call or go to court get an extention (which is 2 months) and the day before or the day of the expiration of the extention is due set a court date. It'll give you time to save up if you need to, or figure what other options you have. I have a ticket from Feb. 14 and my court date is in Nov. 23, plenty of time I might say.
what if the judge is female not a male??...what'll happen then...
just go up to the judge and be like. i really didn't realize i was going this fast. i was very sincere and honest with the officer and he was very polite back. i've fixed both things on my car that he wrote me up for but i just can't afford points or my insurance to go up. and honestly i did not think i was going 53. is there anyway i can get this lowered or maybe go to school and have it dropped?
also....a low cut shirt wouldn't hurt either.

Driving school here in Cali is only like 40 bucks plus the 60 that the court charges you to register for the class. I think that if you honestly CAN'T pay it you should either go to court with all your finances(proof of income and expenses) and make the case for you not being financially able or ask for an extension so that you can have some extra time to save and just pay it. I got a 460 dollar red light ticket and I got a 30 day extension because the clerk of court said that they rarely give reductions unless the person is already receiving aid from the government. Thats norcal though and every judge will be different.

Well, Rissa (fyi I am a cop) the tint and the plate will be dropped cause you "fixed it". Go to your araignment and just talk to the assistan DA ahead of time and you should be able to work something out. That is how it works in Colorado. You go in and talk to the assistant DA and tell her what you want to do and what you will plead to if you get what you want. If you don't like the offer you can fight it, however the judge 99.9 percent of the time will side with the police officer. This is just an inital aperance so they will set a later court date with the police officer scheduled to show up. If you have any other questions PM me.

I am pretty sure you come in with pics of your car 'fixed' or with receipts of said fix, you pay court cost and go home.
Best bet would to be to go, and ask the DA.
SO I went back and read.
Just pay that ticket and take pics of proof of both no tints and a front plate.
Or pay em all

well as you know the whole fixit ticket thing but you need to know about the DA well you have to go talk to him/her try to see them ahead of time explain your situation and they should understand and hopefully give you a good deal i got a majore ticket 95 in a 45 zone pluse fixit tickets lol but when i went in they bumped it down to 60 in a 45 zzone and let me go to trafice school no points just had to pay the ticket lol

Just go to court and plead guilty and cry poverty to the judge, nd a lot of time they will reduce the fine. Or you check out Trial By Written Declaration. You will plaead not guilty and ask for a Trial By Written Declaration, fill out the forms and your side of the story. The cop has to fill out the forms and state his side of the case. The judge reads both sides and renders a verdict. If the cop does not send in his forms the case is dismissed. The great thing about it is if you lose you can file a Trial De Novo Form and the request a new trial, and the original trial is throw out. You can then go to court and ask for traffic school. I tried it but I lost, Requested traffic school and judge gave me traffic school. You have nothing to lose and makes the cop waste his time. One other thing cops don't get paid to do Trial De Novo cases, unlike when they have to go to court and appear on the traffic ticket case.

i got a speeding ticket in 2007 and i went to my court date and talk to the judge and all she did was ask if i was speeding, if i wanted to fight it and if i wanted to do traffic school. by doing traffic school it made my cost go down to $140 and no points on insurance. the cop never shows, especially for fix it and speeding tickets. mine was also for 52 in a 35 lol

I didn't read through everyones posts, but always do trial by declaration. You're more likely to get the case dismissed. Never plead guilty cause you just wasted your time going in cause thats what you're doing when you pay the ticket. And I'm pretty sure as long as the violation can qualify for traffic school they cant make you waive that. As far as tint goes last time I looked into it no aftermarket tint on the front windows and windshield is legal. There's a website called ticketassassin.com From what I've looked at on it it seems pretty imformative. The guy running it shows you how to legally get out of just about any ticket

I am actually a traffic school clerk at the courthouse here in my county and idk bout how your county handles these situations but in my county if you go to your arraignment and plea guilty it doesnt get reduced there is no advantage to going in and pleaing guilty right away. if you choose to plea not guilty they will continue it to another court date and subpeona the officer. the officer will not show up to your arraignment. the date at the bottom of your ticket is your appear date but usually it is already extended. if you have recieved a notice and it says how much you pay the date on that notice is the one you go by. idk bout other counties but in my county we allow two 30 day extentions. the only way people get their fines reduced is to show proof of correction our judge doesnt grant reductions. also in my county, if you plea not guilty you are required to post the full bail amount and it is placed in a trust fund and if you are found not guilty they refund your money. also if you fight your ticket you forfiet your right to go to traffic school and you will need to request it after you are sentenced. you are also able to set up on payments but you are not able to attend traffic school if you make payments. also remember that this is only in my county i have no idea how things work in your county. just trying to help

i know that here in utah there are two prices for the ticket and actual traffic school. however i dont know how it is in cali. at the arraignment they might just talk to you there and make a plea bargin like they do herel. i dont know. but try for traffic school. dont matter how much you have to pay. you will spend less on traffic school then you will pay in the increase of premiums in insurance.

Go talk to the state's attorney. You can usually figure something out then, plus, they are more willing to give you a break, because its less paperwork they need to file. He will prolly make you plead guilty to the speeding, then drop the fix it tickets. You should still be able to go to school and keep it off your insurance. Least, thats how it works in Illinois.

K so I got a speeding ticket and 2 fix it tickets back in July, the total is $432, and that is including traffic school. Now my original intention was to just pay the ticket, and do traffic school, but now I would like to reduce the fine if that is at all possible. I've been hearing some conflicting things. If I show up to my arraignment date and plead guilty and say possibly get my price reduced, do I still have the option of going to traffic school(I've never attended traffic school before) so that my insurance doesn't go up? Or will me showing up to court not allow me to go to traffic school? Anyone knoooww? I'm not down to pay $432....my court date is Oct. 2nd, but I'm thinking about getting an extension. Thanks!
im sarah =] im new to this site
but i was reading abt ur ticket and i've had 5 speeding tickets ! =/
if u want a chance to reduce ur ticket show up it doesnt prevent ur chances of attending traffic school especially if u've never been but thats only if u plead guilty. and if u ask to pay ur bail in payments then u cant do traffic school. if u plead not guilty they'll give u another court date and thats when u hope the cop doesnt show up and u may not be able to do traffic school so its a gamble. but my suggestion is u get as many extensions as u can if u cant pay ur fine =]]]

Not sure if you still need an answer to this or not but I got a ticket for goin 85 in a 55. I ended up doing a trial by mail just BSing it and hoping the cop doesn't fill out the paper work. He filled out the paper work so I ended up loosing the trial by mail. Then I did a declaration asking for a regular trial and to get rid of the trial by mail that I lost. So I had a court date and was hoping the cop wouldn't show up and he showed up so I just pled guilty and then did my traffic school. During the court thing though I did see some lady get her fine lowered but it was because the cop said it. So maybe she talked to him before the court while waiting outside. So you can still get traffic school by pleading guilty in court. They just tell you to go pay in whatever room it is and once you pay they hand you the traffic school info. To confirm it though you can ask the judge that you want to do traffic school.
But I thought fix it tickers are only like 20$ each as long as you get it inspected and signed off.

i got the same ticket you did speading no front plate and tinted windows.
if you want to fix the fix it ticket which is the tint and plate you have to peal off the window tint on the side windows and install the front plate and then go to any police station and show an officer and he will sign off that you have fixed these issues which will drop you fine done to probably 200 dollar range.
Now when you go to court in front of the judge if you plead not guilty they will set another court date for the officer to show and both of you state your case in what happen. if the cop doesnt show which happens more often than not the charge will be dismissed, but if he does show you will have to pay the 200 dollar fine and you can still attend traffic school provided you have not attended traffic school in the last 18 months.
